The Marin County Superior Court of California has issued a new Administrative Order concerning how you may e-file documents into existing cases. Administrative Order 26-01 was issued by Presiding Judge Stephen P. Freccero on February 23, 2026, this new standing order is designed to streamline the court’s review process, eliminate intake delays, and speed up document turnaround times.
Read Administrative Order 26-01The Big Change: Separate Submissions for Each PDF in Existing Cases
Previously, the Marin Superior Court allowed you to upload and submit multiple PDFs in one submission on existing cases. That is no longer allowed for non-Criminal cases.
- File Documents Individually: Every single document that requires its own file stamp and separate docket entry must be uploaded as its own standalone PDF. This includes Motions, Memorandums of Points and Authorities, Declarations, Notices, Proofs of Service, Oppositions, and Responses.
- Separate Transactions: Each individual document must be transmitted so that it generates its own unique transaction receipt and distinct transaction number. This means each PDF needs its own separate filing in an existing case
Our application will no longer allow a filing to be sent to Marin Superior Court on existing cases if more than one PDF has been uploaded to the draft filing. This is per their own E-Filing Manager’s (EFM) configuration as to what they will accept from e-filing vendors.
What Can Still Be Grouped Together?
There are two major exceptions to the individual filing rule:
- Case Initiation Documents: Case initiations are exempt from this new rule. When you are initiating a case, you will continue to upload all related initiation documents as individual PDFs and submit them to the court in one filing.
- Supporting Attachments: Exhibits and supporting documents should still be attached to their lead documents when applicable.
What Isn’t Changing?
Aside from how you split and upload your files, the rest of your filing requirements remains unchanged. This order does not alter existing regulations regarding:
- File size limits
- Exhibit rules
- Bookmarking requirements
- Sealing procedures
- General compliance with California Rules of Court (CRC) 2.250 through 2.261
